Phy Charge — Terms & Conditions of Use

1. Introduction

These Terms & Conditions ("Terms") govern your use of the Phy Charge electric vehicle (EV) charging service ("Service"), operated by Phy Energy ("Phy", "we", "us"). By scanning a QR code, starting a charging session, or otherwise using a Phy Charge charging station ("Charger"), you agree to be bound by these Terms.

2. Eligibility

You must be legally entitled to operate the vehicle being charged and have the authority to accept these Terms on behalf of yourself or, where applicable, your organisation.

3. Starting a Charging Session

  • Charging sessions are initiated by scanning the QR code or accessing the charger's unique link, selecting a connector, and authorising payment.
  • It is your responsibility to confirm you have connected to the correct connector and vehicle before starting a session.
  • Charger availability, connector compatibility, and charging speed are not guaranteed and may vary based on network conditions, vehicle limitations, grid capacity, or maintenance status.

4. Pricing and Payment

  • Charging fees are calculated according to the tariff displayed on the charger page at the time of your session (e.g. per kWh, per minute, or a combination, plus any applicable fixed or session fees).
  • Payment is processed via our third-party payment provider at the start of or during the session. By starting a session you authorise this charge.
  • Where a charger is marked as "Test mode", no real payment will be taken and only test payment cards will be accepted. Sessions in test mode are for demonstration purposes only and are not a substitute for a live charging service.
  • Prices may include VAT or other applicable taxes where required by law.

5. Session Status and Interruptions

  • Charging session status shown on the session page (e.g. charging, paused, stopped, completed) reflects data reported by the charger and may be subject to short delays.
  • Phy is not liable for interruptions to a session caused by factors outside our reasonable control, including grid or utility outages, vehicle-side faults, network connectivity issues, or third-party payment processing failures.
  • You may stop a session at any time via the session page, where available, or by disconnecting your vehicle in accordance with the charger's instructions.

6. Refunds and Disputes

Charges for electricity actually delivered are generally non-refundable. If you believe you have been charged in error (e.g. a failed session, a charge without energy delivered, or a duplicate charge), contact us at info@phy.energy and we will investigate and, where appropriate, issue a refund.

7. Your Responsibilities

  • Use the charger and charging cable safely and in accordance with any on-site instructions or signage.
  • Do not use damaged equipment, cables, or connectors, and report any faults to us immediately.
  • You are responsible for any damage caused to the charger, cable, or site through misuse or negligence.
  • Vehicles must be removed promptly after charging completes where required by site rules; additional fees or penalties may apply for overstaying, where displayed.

8. Liability

To the maximum extent permitted by law, Phy Energy is not liable for indirect, incidental, or consequential damages arising from use of the Service, including loss of time, loss of use of your vehicle, or costs of alternative charging. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Data and Privacy

Information collected during a charging session (such as your email address, vehicle/connector selection, and payment details) is processed in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time you start a charging session will apply to that session.
